What Does This Privacy Policy Cover?

This Privacy Policy is part of Our Terms of Use and covers the treatment of user information, including personally identifying information, obtained by us, including information obtained when you access the Service.

The Information We Collect

We may obtain the following types of information from or concerning you or your mobile phone device, which may include information that can be used to identify you as specified below (“Personally Identifying Information”):

Information you Provide to Us: You provide certain Personally Identifiable Information, such as your mobile phone number, and push notification name (if applicable) to us when choosing to participate in various uses of the Service, such as registering as a user. In order to provide the Service, we will periodically access your address book or contact list on your mobile phone to locate the mobile phone numbers of other Fotoloop users (“in-network” numbers), or otherwise categorize other mobile phone numbers as “out-network” numbers.

Automatically Collected information: Whenever you interact with our Service, we automatically receive and record information on our server logs from your browser or device, which may include your IP address, device identification, “cookie” information, the type of browser and/or device you’re using to access our Service, and the page or feature you requested. “Cookies” are identifiers we transfer to your browser or device that allow us to recognize your browser or device and tell us how and when pages and features in our Service are visited and by how many people. You may be able to change the preferences on your browser or device to prevent or limit your device’s acceptance of cookies.

When we collect the usage information described above, we only use this data in aggregate form, and not in a manner that would identify you personally.

Sharing of Personal Information

We neither rent nor sell your Personal Information in personally identifiable form to anyone. However, we may share your Personal Information with third parties as described in this section:

Aggregated Personal Information that’s no longer personally identifiable: We may anonymize your Personal Information so that you are not individually identified, and provide that information to our partners. We may also provide aggregate usage information to our partners, who may use such information to understand how often and in what ways people use our Service. However, we never disclose aggregate information to a partner in a manner that would identify you personally, as an individual.

Agents: We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you. Unless we tell you differently, our agents do not have any right to use the Personal Information we share with them beyond what is necessary to assist us, unless otherwise described in this Privacy Policy.

User Profiles and Submissions

Certain user profile information, including your name, and any image content that such user has uploaded to the Service, may be displayed to other users to facilitate user interaction within the Service or address your request for our service. Please remember that any content you upload, along with any Personal Information or content that you voluntarily disclose online in a manner other users can view (on discussion boards, in messages and chat areas, etc.) becomes available to those selected users, and can be collected and used by them. Your user name may also be displayed to other users if and when you send messages or comments or upload images through the Service and other users can contact you through messages and comments.

In the Event of Merger, Sale, or Bankruptcy

In the event that the Service is acquired by or merged with a third party entity, we reserve the right to transfer or assign the information we have collected from our users as part of such merger, acquisition, sale, or other change of control. In the event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, we may not be able to control how your personal information is treated, transferred, or used.

We reserve the right to access, read, preserve, and disclose any information that we reasonably believe is necessary to comply with law or court order; enforce or apply our Terms of Use and other agreements; or protect the rights, property, or safety of the Provider, our users, or others.

The Way We Use Information

If you submit Personally Identifiable Information to us through the Service, then we use your personal information to operate, maintain, and provide to you the features and functionality of the Service. In particular, your mobile phone number is essential to your use of the Service and will be retained. We do not use your mobile phone number or other Personally Identifiable Information to send commercial or marketing messages without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out. We may, however, use your mobile phone number without further consent for non-marketing or administrative purposes (such as notifying you of major Service changes or for customer service purposes). We may use both your Personally Identifiable Information and certain non-personally-identifiable information (such as anonymous user usage data, cookies, IP addresses, browser type, clickstream data, etc.) to improve the quality and design of the Service and to create new features, promotions, functionality, and services by storing, tracking, and analyzing user preferences and trends.

Our Commitment to Data Security

We use commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information. We cannot, however, ensure or warrant the security of any information you transmit through the Service and you do so at your own risk. Using unsecured wifi or other unprotected networks to submit messages through the Service is not recommended. Our Commitment to Childrens’ Privacy

Protecting the privacy of young children is especially important. For that reason, we do not knowingly collect or maintain Personally Identifiable Information or non-personally-identifiable information on the Service from persons under 16 years of age, and no part of the Service is directed to or intended to be used by persons under 16. If you are under 16 years of age, then please do not use Service at any time or in any manner. If we learn that Personally Identifiable Information of persons under 16 years of age has been collected on the Service, we may deactivate the account.

Special Note to International Users

If you are a user accessing the Service from any region with laws or regulations governing personal data collection, use, and disclosure, that differ from European Union laws, please be advised that through your continued use of the Service, which is governed by Spanish law, this Privacy Policy, and our Terms of Use, you are transferring your personal information to Spain and you expressly consent to that transfer and consent to be governed by Spanish law for these purposes.

Your Choice

You may, of course, decline to submit Personally Identifiable Information through the Service, in which case we may not be able to provide certain services to you. If you do not agree with our Privacy Policy or Terms of Service, please delete your account, uninstall the Fotoloop mobile application and discontinue use of the Service; your continued usage of the Service will signify your assent to and acceptance of our Privacy Policy and Terms of Use. To protect your privacy and security, we take reasonable steps (such as SMS authentication in certain cases) to verify your identity before registering your mobile phone number and granting you access to the Service.
